Marketplace Terms & User Verification Charter
1. NATURE OF SERVICE & LIMITATION OF LIABILITY
1.1 Peer-to-Peer Marketplace Framework: CAR.LO RENTAL operates exclusively as a decentralized, peer-to-peer automotive marketplace and digital directory service accessible via www.carlopk.com. The Company provides an online portal connecting independent vehicle fleet owners, showroom operators, and individual car providers (collectively referred to as "Owners") with prospective individuals seeking vehicle rental solutions (referred to as "Clients" or "Renters"). CAR.LO RENTAL is not a direct rental agency, does not own the vehicles listed on the platform, and does not act as a principal party in the physical lease or deployment of vehicles.
1.2 Complete Indemnification Against Accidents and Damages: Since all transaction execution, physical inspections, price handling, and vehicle handovers occur directly between the Owner and the Client, We maintain zero operational control over the vehicles or the parties involved. In the event of a traffic collision, major accident, mechanical damage, structural failure, third-party injury, or fatality involving a vehicle discovered via Our platform, CAR.LO RENTAL, Our management, and Our brand, assumes absolute zero legal or financial liability. All liabilities, workshop costs, loss of utility expenses, and legal disputes are strictly a bilateral matter between the Owner and the Client.
1.3 Authorized Regulatory Data Sharing Protocol: While We are not a party to the rental agreement, the Company prioritizes marketplace safety and structural transparency. In the event of an accident, vehicle theft, default, or illegal activity where formal documentation is requested, We explicitly reserve the unilateral right to disclose, share, and transfer the registered Client’s profile data, email records, logged contact details, and platform interaction logs directly to the affected Owner or to state law enforcement and judicial authorities in Pakistan to assist in investigations or recovery processes.
2. PLATFORM DATA INTEGRITY & SECURE ACCESS CONTROL
2.1 Accuracy of Brand Listings and Verification Thresholds: We are committed to maintaining high structural integrity across Our public vehicle gallery. We assume strict responsibility for ensuring that vehicle listings are formatted correctly, that information is structurally organized, and that blatant misrepresentations or system bugs are actively audited. However, the foundational details (such as mechanical health, internal trim conditions, and operational readiness) remain the exclusive representation of the listing Owner.
2.2 Mandatory Email Authentication and Access Controls: To access Our marketplace ecosystem, communicate with owners, request quotes, or manage inventory, all Users—both Clients and Owners—must undergo a mandatory digital onboarding process. Access to the portal is restricted exclusively via secure email authentication. Users can only log into their personal dashboard or corporate portal through verified email credentials, ensuring a clear digital paper trail for all actions performed.
3. OWNER RIGHTS, CHANNELS OF DELIVERY & AUTONOMY
3.1 Unilateral Control Over Verification and Handover Selection: The Owner maintains full ownership, legal autonomy, and sovereign decision-making rights regarding how they manage, verify, and lease their automotive assets to Clients introduced via Our platform. The absolute discretion to approve a Client, refuse a handover, or cancel a transaction rests solely with the Owner. The Owner is entirely responsible for executing background checks, analyzing risk factors, and approving or denying rental requests based on their localized security assessment.
3.2 Operational Flexibility (Self-Drive versus Chauffeur-Driven): The operational decision regarding how a vehicle is dispatched—whether it is leased on a strict self-drive basis or supplied exclusively with a professional driver (chauffeur-driven)—rests entirely with the listing Owner. We have no involvement in prescribing delivery mechanisms, defining localized geographical restrictions, or shaping the operational terms of individual vehicle providers.
4. FLEET OWNER & PARTNER LISTING INTEGRITY (ANTI-FRAUD CLAUSE)
4.1 Prohibition of Deceptive and Fake Advertisements: All registered Owners utilizing the CAR.LO RENTAL Business Portal to upload, advertise, or lease their vehicles are strictly required to provide authentic, accurate, and real-time information. It is explicitly forbidden to upload deceptive listings—including, but not limited to, attaching images of a premium vehicle (e.g., Honda City) to an advertisement or listing for a different vehicle class (e.g., Suzuki Alto), misrepresenting the vehicle’s model year, or concealing existing mechanical damages.
4.2 Penalties for Fraudulent Activity and Misrepresentation: In the event that any fake activity, malicious listing, intellectual property theft (using internet-sourced images), or deliberate misrepresentation is detected, We reserve the legal right to take immediate punitive action without prior notice. These actions include, but are not limited to, immediate removal of the listing, a permanent freeze or complete deletion of the Owner’s corporate account and Business Portal access, and the forfeiture of platform privileges.
5. FINANCIAL DISCLOSURES: SUBSCRIPTIONS & ADS
5.1 Mandatory Fleet Portal Subscriptions: To list automotive inventory, access the secure management dashboard, review incoming client booking leads, and operate on the platform, all automotive providers must maintain an active, paid CAR.LO RENTAL Vendor Subscription Plan. Access to the portal and active directory publishing is strictly contingent upon the timely settlement of recurring subscription fees.
5.2 Independent Premium Featured Ad Tariffs: If a registered Owner desires to maximize their vehicle's visibility, drive higher conversion rates, and position their specific asset at the top of Our public rental gallery, they may utilize Our Featured Ad Upgrade Option. The charges for Featured Ads are completely independent, distinct, and separate add-on tariffs that must be settled in addition to the standard base subscription fee. Promotional fees are entirely non-refundable.
6. CLIENT GUIDE & MANDATORY VERIFICATION
6.1 Platform Educational and Operational Guidance: We provide clear educational guidelines, navigation paths, checkout interfaces, and customer experience frameworks to guide Clients seamlessly on how to discover, select, and initiate vehicle bookings within Pakistan. However, We require that all physical onboarding materials, signed registration sheets, and complete structural documentation submissions must be handed over directly to the Owner at the time of contract formalization.
6.2 Mandatory Criteria for Domestic Clients (Self-Drive)
- Financial Security Instrument: A valid, completely blank, original bank account check, signed exclusively by the primary registered Renter, to be submitted as financial indemnity against severe asset damages or contract violations.
- Residential Verification: Authentic proof of residential stability. The Renter must prove ownership or stable residency of a personal family home located within the exact city where the vehicle is being booked and dispatched. Rented or temporary domestic addresses are subject to direct rejection by Owners.
- Mandatory Family References: Two (2) verified, active references from immediate family members, including complete contact numbers and valid CNIC records, for emergency cross-verification.
6.3 Mandatory Criteria for Overseas & International Clients
- International Identity Passports: An original, valid international passport along with valid entry visa stamps or official overseas resident documentation.
- Localized Stay Verification: Definitive proof and address verification of their exact place of stay, lodging, hotel reservation, or family property location in Pakistan for the duration of the lease.
- International Professional/Business Authentication: Overseas clients must present clear proof of active employment or business ownership in their respective country of residence (official corporate IDs, foreign business registration, or certified employment letters).
7. GOVERNING LAW, SITE RULES & SEVERABILITY
7.1 Choice of Law and Legal Competence: This comprehensive Legal Charter, marketplace policy structure, and operational framework shall be exclusively governed, analyzed, and enforced in complete alignment with the federal and provincial legal codes of the Islamic Republic of Pakistan. Any legal actions or mutual arbitrations must be addressed exclusively within the civil courts of Pakistan.
7.2 Severability of Marketplace Sections: If any particular section, sub-clause, or single provision outlined within this document is declared invalid, illegal, or completely unenforceable by a competent judicial court, such localized ruling shall have no structural impact on the remainder of this document, which shall maintain full legal authority and enforcement across all active platforms.
